Abstract

Penal law should be sufficiently definite for those to be affected by it that they may know their duty there under, so that persons of ordinary prudence may be able to understand the provisions of it. If the law is certain, definite and precise the individual can regulate their conduct and activities in order to avoid the risk of failing within the grips of its penal provisions. Phraseology of section 511, I.P.C is most confusing. It is not only of “little assistance” in defining “attempt” but, contrary to legislative intent, also suggests that each act, in series of acts done by an accused “towards the commission of the offence”, is punishable as an attempt. The phraseology nowhere gives us any hint about what test is to be used for determining the starting and end point of the attempt. It is the judiciary which invents the tests and is proved to be a futile exercise, as it is very difficult to distinguish between preparation & attempt and also to find out what will be the end point of attempt i.e. up to what stage the attempt is in action.

Abstract

The NREGA provided that, 100 days of guaranteed wage employment should be provided to every rural household seeking unskilled manual work. Quite succinctly, the Act led to a paradigm shift in the way earlier government employment generation programmes were conceptualized and implemented. It made employment a basic right of individual, which a government could not deny, or in such case will have to pay compensation. The Act also made it compulsory to put in place several transparency and accountability mechanisms like social audit, which handed the baton of democracy right into hand of individuals and communities. It also, in certain ways transformed the information management system drastically with field level offices required to provide regular updates on progress of the scheme, which is available throughout the country and is a remarkable example of e-governance.

Abstract

The history of the mostly acrimonious relation between India and Pakistan stems from the traumatic event of partition that played itself out in ‘all its gory’ and violence around the area surrounding the Radcliff line that was drawn hastily by the British lawyer Sir Cyril Radcliff in August 1947. With barely five weeks between start and finish, Radcliff had to chair not one but two boundary commissions: one for Bengal in the east, another for the Punjab in the westv(Jisha Menon). In August 1947, the labour pains prior to the birth of the fraternal twins-Indian and Pakistan were intense, prolonged and tumultuous leading to a situation in which roughly one million people died, ten to twelve million were displaced, thousands of women were raped and property suffered a staggering loss. In the weeks leading up to August 14-15th, communal violence began to break out across India. Hindus, Muslims, and Sikhs were forced from their homes and ancestral lands as the new border was drawn between India and Pakistan. Upon Partition, the situation worsened with trains full of refugees that were going either way across the border, being attacked and finally arriving at their destinations full of corpses.

India’s abstinence from the OBOR Summit in Beijing should not be premised only on India’s objection to the construction of the China Pakistan Economic Corridor (CPEC), but the strategic implication OBOR and its projects in the region would have for the region. This paper argues that: a) Chinese deeper involvement with states within the Indian neighbourhood, and b) the strategic implications of the OBOR projects, brings to live India’s apprehensions of a Chinese ‘concirclement’ as was postulated by the ‘string of pearls’ strategy.

This region is characterized by a rich indigenous culture. Each culture has its own oral tradition. The importance of oral tradition for every culture is enormous. For many indigenous communities of the Indian state of Manipur, as is the case with many indigenous communities in India’s Northeastern region, oral tradition is often the only means for tracing the indigenous culture. Oral tradition thus plays an almost inestimable role in the culture affected by assimilation, transculturation etc. in today’s changing world. This paper is an attempt to briefly explore the Tangkhul’s oral tradition and its importance for tracing the indigenous culture. In essence, the paper seeks to open up new methods of enquiry by studying the oral traditions closely concerning the preservation and promotion of oral tradition.

Abstract

When one identifies “globalization” as the “buzzword” of our times, what one does not very much risk is being accused of making an overstatement. A cursory glance at titles of books, articles, debates or talk inside and outside of the academia can make a strong case with comparative ease against skeptics if not convince them altogether. Everyone seems to be talking about globalization everywhere. At the same time, this ubiquity of the concept renders it a certain degree of woolliness which makes arriving at neat definitions an impossibility. Susan Strange referred to this problem when she declared in her now-famous words that globalization is “a term which can refer to anything from the Internet to a hamburger” (Strange, 1996: xiii). Essentially, this also means that it is not easy to talk about globalization in general terms. The context, in effect, determines all.

Abstract

The idea of international organization has probably been around since the advent of the first governments. From the writings of ancient Greek philosophers, for example, we learn of military alliances and international trading agreements. The early Greek city – states Athens, Sparta and Macedonia once employed a common currency, which required a high degree of international cooperation. According to the stone scripture in Orissa, the three Ancient Tamil Kingdoms of Chera, Chola, and Pandya had an alliance among them against the central and north Indian kingdoms threat. We can say that the congress of Vienna as the earliest modern precedent to today’s International Organisation. The congress of Vienna, a multipurpose IO was created by the European great powers to re establish order and stability on the continent after the Napoleonic Wars. The next important IO was the League of Nations which was established after the First World War. The League of Nations embraced the idea of collective security where international security is directly tied to the security of member states. The UN system was created in 1945 following World War II.

The layman and most courts look upon parole as a gift to the convict, an act of leniency on the part of the executive, frequently given as a reward for good behavior in prison. Strictly speaking parole is a privilege and no prisoner is entitled to it as a matter of right. The significance of parole lies in the fact that it enables the prisoner a free social life, yet retaining some effective control over him.
