ONE PERSON COMPANY UNDER NEW COMPANIES ACT 2013: RATIONALE AND FEASIBILITY

Abstract

Since the enforcement of new co Act 2013, various new emerging issues hasbeen introduced in this applicable Act like Meeting Through Video Conferencing, Serious Fraud Investigation Office,Corporate Social Responsibility,National Company Law Tribunal, Insider Trading, Key Managerial Person, and Women Directoretc. The New companies Act 2013 has brought the Plethora changes with vast amendment as comparatively with the previous Companies Act 1956. The main objective of this new prevailing Act 2013 is strengthening the grip on auditor to work with diligently and honestly to disclosure the proper information to the concerning stake holders to protect their interest. The present article attempts to elaborate the rationale and feasibility of One Person Company under Companies Act 2013 and provision applicable on it. Undoubtly it is an excellence effort done by the Government to provide opportunity to a person to form a company with limited liability and less strict legal compliance.
