CONJUGAL RIGHTS OF PRISONERS: IMPRISONMENT DOES NOT MEAN FAREWELL TO FUNDAMENTAL RIGHTS

Abstract

Traditionally, the right of prisoners to have visitors while incarcerated has been strictly limited by prison authority. The liberalizing trend of judicial decisions over the years regarding visitors and associations have been drastically curtailed by such cases as Sandin v. Conner ,1 which held that only state created liberty interests were constitutionally protected. However, limits on the rights of prison authorities to search visitors remain viable, either on the fourth amendment grounds or privacy grounds.
