EVIDENTIARY VALUE OF HOSTILE WITNESS

Abstract

The problem of hostile witness has gained momentum in our country during the recent years and was greatly highlighted in many high-profile cases like the Best Bakery case, the Jessica Lal case and others. Thus it is the need of hour to understand the problem and its implications. Witness plays very important role in the trial Bentham has rightly stated that, witnesses are the eyes and ears of justice. Even Wadwa, J. said “witnesses are required, whether it is direct evidence or circumstantial evidence." A Supreme Court lawyer and expert in cyber law and technology, Pavan Duggal says in our country, you need to prove a case to get justice and witnesses are often the basic foundation of proof.
