Corporate criminal liability is a broad and developing field with courts and commentators continuing to grapple with both philosophical and practical issues, as evident from this very case. There are two distinct aspects in the field, which unfortunately often tend to be conflated. First, it is necessary to consider the principles of attribution, whereby the actus reus and/or mens rea of a corporate officer is attributed to that of the company. In other words, the action or state of mind of a corporate officer is treated as if it is that of the company so as to make the company liable in criminal law.

Abstract

Organizational behavior is an applied branch of psychology that seeks to understand human behavior in organizational settings. Organizational Behavior researchers have recognized that many of the variables studied in Operations Management, such as process enabling technology, lean inventories, and cross training are important to understanding that setting (Parker and Wall, 1998). However, Organizational Behavior researchers tend to take the Operations Management variables as given contexts in their study of behavioral variables such as motivation, job satisfaction and individual differences (in, e.g., responses to technology). Although Operations Management researchers as far back as the 1960s (such as Norman Dudley and Ezey Dar-El) sometimes worked in the interface between Organizational Behavior and Operations Management (especially looking at fatigue or individual differences in ability), a long period of focusing on normative models which ignored human behavior (as described above) characterized Operations Management research until the late 1990s (Doerr et al., 1996; Hayes and Hill, 2001; Schultz et al., 1998). Currently in Behavioral Operations, researchers seek to understand the implication of behavior (and the findings of Organizational Behavior research) for the design of the "context" variables which are within the domain of traditional Operations Management.

India is a country surmounted by about 100 types of taxes but if we try to classify them then two broad categories are there i.e. Direct tax and Indirect tax. The basic difference between the two is the pinch that is felt by the giver. In case of direct tax the pinch is directly felt by assesses whereas in case of indirect taxes pinch is not directly felt. It is also felt that collection of indirect taxes is comparatively easier for the government rather than collecting direct taxes. As far as chances of tax evasion are concerned tax evasion in case of direct taxes is more rather than tax evasion in case of indirect taxes. Systematic maintenance of records is required in case of indirect taxes but no such recording is required in case of direct taxes. From the time we are born till the time we are dead we are not aware of the fact that how much we have paid up till now. On the packets of goods it is written in bracket of price tag inclusive of all taxes. Indirect taxes are inflationary in nature. They are applied on some value of a commodity which is generally known as Assessable value. On this Assessable value it is applied at a particular rate that is why it is known as Ad valorem duty.

Sacrifice (yajña) was of central importance in the Vedas, a vast corpus of religious texts orally composed, compiled, preserved and transmitted across generations by families of male poets-cum-priests/ritualists in north-western and northern parts of the Indian subcontinent. Of particular significance to the study of sacrificial rituals is a genre of later Vedic texts, the Brāhmaṇas, prose texts attached to the Saṃhitās or collections of verse hymns that were deployed as sacred formula (mantra) in the rituals. The Brāhmaṇas describe and comment on the sacrificial rituals in exhaustive detail: they contain an elaborate repertoire of myths, metaphors, symbols, etymologies, largely devoted to explaining the use and significance of mantras and rites. In these texts, sacrificial ritual was conceived of as a perfectly ordered mechanism, mediating between the human and transcendental realms and purported to dominate and regulate the cosmic processes, both as regards the individual’s life and world at large. Speculation on procreation and creation are abundant in these ritualistic texts and are hinged on the perceived potency of sacrifice as a perfect means of orchestrating ‘paradigmatic’ cosmic creation and human procreation.

In the discussions on development initiatives, the term ‘social capital’ is gaining much attention. The concept of social capital is broad and commonly used to refer community spirit, civic virtue, trust, cooperation, friendship, social mobilization, informal and formal networks and so on. The World Bank (1998) defines social capital as “the institution, relationships and norms that shape the quality and quantity of a society’s social interaction”. Economics, political science, sociology, and regional science literatures make a strong case that “non-economic” factors influence economic growth and development. Some even argue that increased levels of social capital can generate a better capacity for development initiatives than markets and political institutions. There are empirical evidences that increased levels of social capital can create a greater capacity for development initiatives.

India is expected to emerge as one of the leading economies in the world over the next decade in the light of a positive political and economic scenario. The Micro, Small & Medium Enterprises (MSME) segment is expected to play a significant role in the emergence of the Indian economy. The development of this segment is extremely critical to meet the national imperatives of financial inclusion and generation of significant levels of employment across urban, urban and rural areas across the country. Further, it can nurture and support development of new age entrepreneurs who have the potential to create globally competitive businesses from India. MSME can be the backbone for the existing and future high growth businesses with both domestic and foreign companies investing in the ‘Make in India’ initiative and make significant impact in the area of indigenisation. ‘Make in India with zero defect and zero effect’, is a significant opportunity. The new wave MSME should enable the development of a business eco system that enables and continuously support business that are gearing to deliver the right product, the right quality, the right solution and the right service at a competitive price, both in domestic and international markets.
